WARRANTY COVERAGE TERMS

 

1. WARRANTY COVERAGE TERMS

  • All commercial kitchen equipment ("Goods") sold by Ty Innovations Pte Ltd ("Seller") to the Buyer is covered under our standard manufacturer's warranty (the "Warranty") in effect at the time of delivery.
  • This Warranty is extended exclusively to the specified Buyer of the Goods and is non-transferable.

2. WARRANTY FOR GOODS SOLD

  • The warranty period for the Goods shall be 12 months from the date of delivery of the Goods, unless otherwise specified in the sales agreement/quotation/invoice.
  • A serial number sticker will be affixed in a clearly visible location on the equipment. For warranty verification purposes, this sticker must remain intact for validation. If the sticker is found to be tampered with, removed without authorisation, or intentionally altered to obscure the serial number, the warranty will be considered void.
  • In the event the Buyer sells the Goods to a third party, or in the event the Goods are no longer in the possession and in control of the Buyer, the warranty for the goods shall cease and shall no longer be applicable.

3. WARRANTY COVERAGE AND EXCLUSIONS

  • This Warranty applies strictly to component(s) found to be defective due to manufacturing faults or substandard material quality. It does not cover equipment faults, damage, or malfunctions caused by (but not limited to) the following circumstances:
    • Improper or incorrect installation, or failure to take necessary measures to ensure the Goods performs according to professional standards;
    • Inadequate or unsuitable electrical, water, gas, or ventilation connections, including insufficient discharge systems for combustion products;
    • Power supply issues such as overloads, surges, or interruptions in electricity, water, or gas;
    • Failure to follow the instructions provided in the user and maintenance manuals, including usage beyond the intended operating limits;
    • Any maintenance or repair work carried out by unauthorized personnel not approved by the Seller;
    • Use of non-original, incompatible, or unauthorized spare parts, accessories, or consumables;
    • Unauthorized modifications, tampering, or alteration of the Goods' original functions, settings, or built-in safety features. This includes any adjustments made by the Buyer without prior guidance or written instructions from the Seller. Should such actions result in operational issues or damage, the Warranty will be deemed void.
    • Neglect, improper maintenance, or failure to perform routine upkeep as specified in the manual, including but not limited to improper use, misuse by untrained personnel, or damage due to corrosion, scaling, condensation, stray currents, aggressive water conditions, or other environmental factors.
    • Inadequate preventive maintenance resulting in suboptimal performance of the Goods, such as blocked condensers or evaporators, damaged sensors, or other issues that lead to further component failure in the refrigeration system.
    • Improper internal storage conditions, including overstocking or poor arrangement of items inside the unit, which restrict airflow, cause internal icing, fan blockages, or ventilation failure-leading to potential component malfunction.
    • Obstructed or insufficient external ventilation, where airflow around the equipment is restricted due to blocked surroundings or improper installation, causing overheating, compressor or component failure.
    • Any damage caused by pests, including but not limited to rodents, cockroaches, ants, or other insects or animals, such as chewed wiring, nesting in electrical or mechanical components, contamination, or obstruction of internal systems.

4. EXCLUSIONS DUE TO WEAR AND TEAR AND EXTERNAL EVENTS

  • The Warranty does not cover:
    • Normal wear and tear of components or parts not arising from a manufacturing defect;
    • Any damages resulting from transport, mishandling or non-operational circumstances such as fire, flood, theft, accidents, strikes, lockouts, or other events of force majeure, including any unforeseen or uncontrollable incidents not preventable with reasonable care.

5. WARRANTY CLAIM PROCESS

  • Notify the Seller's Customer Service Department of the defect within a reasonable period of not more than 5 working days of discovering the issue.
  • Service call Availability
    • Warranty-related service calls are available during regular office hours only:
      • Monday to Friday: 8:30 AM - 5:30 PM 
      • Saturday: 8:30 AM - 12:30 PM 
      • Sunday & Public Holidays: Closed

Any requests after 3PM (15:00) Hours on the same day or received outside of operating hours, will be addressed on the next business day or based on the earliest available schedule.

6. PROOF OF PURCHASE AND ISSUE REPORTING

To initiate a claim or service request, the Buyer is required to provide valid proof of purchase and delivery date for the relevant Goods. Additionally, the following details must be included to facilitate prompt processing:

  • Goods Serial Number
  • Invoice Number or Copy of the Sales Order
  • Delivery Order reference
  • Clear description of the issue, including photos or videos (If possible)
  • Any available maintenance records
  • Other relevant documentation, if applicable

7. INSPECTION AND VERIFICATION

  • The Seller reserves the right to inspect the Goods to verify the reported defect before approving any claim on its Warranty. The inspection will be carried out by the Seller's in-house technical team or, where applicable, by authorised personnel or designated service agents.
  • If the Goods are under Warranty, the Seller will first attempt a remote assessment of the issue based on photos, videos, and information provided by the Buyer.
  • If the issue cannot be resolved remotely, the Buyer will be advised that an on-site inspection by a technician may be required. At such an inspection:
    • If the Seller determines that the defect/fault is covered under the Warranty, no charges will apply, unless otherwise specified.
    • However, if the issue is determined not to be caused by a defect in the Goods or its components, the Seller reserves the right to charge a service fee for the on-site inspection and related logistics.
  • In cases where the reported issue is determined to fall outside the scope of the Warranty, the Seller may issue a quotation for logistics, inspection, and/or service charges prior to proceeding with any further service work. Charges will only be incurred with the Buyer's prior agreement.

8. REPAIR OR REPLACEMENT

  • If a claim under the Warranty is approved, the Seller will, at its sole discretion, either repair or replace the defective component(s) at no cost to the Buyer.
  • All Warranty-related repairs or replacements must be carried out by authorized personnel or appointed service providers of the Seller. Any servicing conducted by unauthorized third parties shall void the Warranty.

9. NON-WARRANTY REPAIRS AND CHARGES

  • For all services or repairs not covered under the Warranty, any costs incurred —including labour, parts, and on-site interventions-shall be borne solely by the Buyer. All non-Warranty work must be carried out by authorized technical personnel.

10. SERVICE WARRANTY

  • Any parts that are repaired or replaced under the Warranty are covered for the remaining duration of the original Warranty period applicable to that specific parts.
  • In addition, the Seller warrants that any service work performed will adhere to the professional standards customary in the commercial kitchen equipment industry. If the Buyer notifies the Seller in writing within 14 calendar days of any service deficiency, the Seller will, at its discretion:
    • Re-perform the service at no additional cost; or
    • Provide a quotation and charge an agreed amount for any necessary service work or additional replacement parts
  • This re-performance or additional service at cost (as determined by the Seller) shall constitute the Buyer's sole and exclusive remedy and the Seller's entire liability for any claims related to service deficiencies.

11. SERVICE AFTER WARRANTY PERIOD

  • After the expiration of the warranty period, repairs and services are available at the applicable service rates of the Seller.

12. LIMITATION OF LIABILITY

  • The Seller's liability under this Warranty is strictly limited to the repair or replacement of defective components as outlined in this Warranty.
  • Under no circumstances shall the Seller be held liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of profits, downtime, or loss of business, arising from the use or inability to use the Goods.

13. INDEMNIFICATION

  • The Buyer agrees to indemnify and hold harmless the Seller from and against any claims, liabilities, losses, damages, or expenses arising from the Buyer or any intermediary providing or implying warranty coverage beyond the scope of this Warranty.
  • The Seller's responsibility is strictly limited to fulfilling its obligations under the Warranty. The remedy provided in the Warranty shall be the sole and exclusive remedy available to the end user for any defect or failure in the Goods.
  • The Seller shall not be liable for any loss, damage, or consequential claims resulting from delays in carrying out Warranty-related interventions or service.
